Standard requests counsel on appeal from the District Courts judgment dismissing his habeas corpus petition. Standard was convicted of being a persistent felony offender and was sentenced to fifteen years imprisonment in lieu of three years on his simultaneous conviction for theft over $100. The District Court dismissed the petition as an abuse of the writ. This appeal has been referred to a panel of the Court pursuant to Rule 9(a), Rules of the Sixth Circuit. After examination of the record and Standards informal brief, this panel agrees unanimously that oral argument is not needed. Rule 34(a), Federal Rules of Appellate Procedure.
